Brett Michael Kavanaugh, 53, is the candidate of Donald Trump to become a judge of the Supreme Court of Justice, the highest court in the United States. The American lawyer will have to receive the approval of the Senate before taking office, replacing also the magistrate Anthony Kennedy, who formalized his retirement in June 2018, after serving more than 30 years in office, former president Ronald Reagan nominated him for that position.

His possible designation, among other things, could bring future problems for the Latino immigrant community that seeks to reach the United States. Why?

The first thing that must be understood is that the Supreme Court of Justice has, for example, the power to decide on important issues as abortion, death penalty, voters’ rights, immigration policies, financing of campaigns, and racial matters.

This context, focused on immigration policy, could be negative for the Latino community that seeks to reach the United States, since Kavanaugh is Trump's candidate, which is probably why the magistrate would not hesitate to support voting for his migratory policy. This program contemplates, according to EFE, reducing the legal entry of foreigners and introduce a system of points similar to the one that works in countries like Canada, Australia, and New Zealand. To legally entry the country depends on aspects such as the academic level and the language’s knowledge (English).

A 2011 study by the Migration Policy Institute (MPI), titled "Mexican and Central American Immigrants in the United States," revealed that Mexicans have the lowest educational level compared to other Latin countries. This situation, under Trump's immigration policy, would be a major obstacle for all those seeking to enter the United States.

What does Kavanaugh represent for Trump?

What are his chances of winning?

For now, the White House and the Republican Party hope it will be confirmed before the legislative elections on November 6. If Kavanaugh wins, Trump will celebrate.

In the future, reports BBC, "Democrats will surely put pressure on Trump's nominee in connection with the landmark 1973 Roe vs. Wade ruling, which legalized abortion throughout the country." On the contrary, "conservative (republican) Christians" will fight to revoke the decision.

Kavanaugh's election could be complicated because of the accusations of sexual abuse. On September 27, psychologist Christine Blasey Ford made public the sexual abuse she was victim of by Brett Kavanaugh. Blasey Ford gave the following statements:

“Brett touched me and tried to take my clothes off. It cost him because he was so drunk and because I had one piece bathing suit under my clothes. I thought he was going to rape me. It was very hard for me to breathe, and I thought that Brett was going to accidentally kill me".

“Mark encouraged Brett, but sometimes told him to stop. A couple of times I made eye contact with Mark and I thought he would help me, but he did not. Mark tried to climb onto the bed a couple of times while Brett was on top of me. The last time he did it, we turned around and Brett was no longer on me. Then I could get out and run out of the room".
